Hempstead, June 0.—The priue uf gus should come down. In the opinion of V'illage Tru.stee Muncke, who tllscussed the inatter Informally at the Village Board meeting Tuesday. He exores-sed the opinlttn that the lower cost of mate- ilals would warranl a reduction, and liointed to the fact that the price has been voluntarily reduced' 25 cents by the conipany in Brooklyn. He also sjioke of the advice of the coun.sel for the town of North Hempstead, that consumeis should not pay the service charge Imposed until the questign of its legality is decided by the Appellate Division.
The opinion rerprred to was by J^mes L. Dowsey of Dow.scy & Parsons, and was made to the town board at Man- lia.-<set.
Mr. Dowsey based his contention ui'- on the opinion that the corporation has no right to exact a meter .service t'hartte on section 66 of the transpoita- tions corporation.s law, under^whieli, he .say.s, the Public Service Coiiioiation wns organized. He quotes from this section in efl'ect as follows: "No gas light cor- lioration in this state shall cluirgi- or collect rent on its gas meters." Also "There shall be a flne of $50 for each offtjnse, to be sued and recovered in the corporate namt; of the city or village."
Mr. Do\vsey cited the case of the city of Buffalo agaiifist the Buffalo (la.s Company, wherein tho auestion arose as to whether or not a "minimum ser¬ vice charge" was In violation of this statute, and .ssiys that the court held that the name by which the chaige was called was immaterial, and the charge was contrary to the provision of the statute referred to. In conclusion. Mr. Dowsey said:
"We are advised that thi.s tiuestion (the legality of the Kervice charge) is before the Apjiellate Division of the Third Department, and pending that decision, we would suggest that the consumers pay for gas actually .con¬ sumed tipon their premises and refrain from paying the "meter service charpc' or pay the 'meter .service charge' under protest, so they may be reimbursed should the court decide ndversely to the company.
