The trial of Milen Rhodes, third of the' ex-jallers implicated In the serlouf charges for which they were Indicted by the March Grand Jury, was cloaed Thursday afternoon In the Supreme Court at IMneola amid a scene of ul tra Impresslveness. His aged father, Alexander R. Rhodes, prominent fo.- years In Freeport, sat at the south side of the courtroom, his face bur¬ led In his hands, and his two brothers Oscar, and Charles, shaken with emo¬ tion, sat together in front of the gal¬ lery rail.
The closing remars of District At¬ torney Lewis J. Smith, eloquently de¬ livered, followed the dramatic sum¬ ming up of Harry G. Clock, of Free- port, of counsel for the defense. There was a sullen silence in the room when Justice Kelby made his charge to the jury. Rhodes' head was bowed.
The trial itself waa unusual. The testimony of those who were In thc; Jail at the lime of the alleged orgies for which the ex-jailers were indicted appeared to have a lesser effect upon the jury, several of whom were from this vicinity, that during the case of Miller. There was a strong appeal in the statements of two men, Frank Ash¬ down, Receiver of Taxes In Freeport, and ranklin Bedell, a village trustea here and Overseer of the Poor lc Hempstead township, who testified ai character witnesses for Rhodes.
The jury deliberated until after eight o'clock before the flrst report Was made and then they aaked for instructions. The lumor at that time was that eleven stood for conv'ctlon and one for acquittal. But when they flnally concluded their consideration.-* of the case, there was an open disa¬ greement, eight unalterably for acquit¬ tal and four for conviction, accordinij to the report.
The case was the longest of the three. Miller was found guilty and sentemced to not lees than three years and not more than six years in Sin;; Sing at the close of trial tbat lasted
a day and a half; Clifford pleaded guilty and received the same sentence and ex-warden Winfield Box was dis charged upon motion of Surrogate John J. Graham on Thursday morn Ing, the motion being unopposed by District Attorney Smith. It was se' forth that there was no corroboration of the testimony of Laura Myers, wbo appeared in all of the cases as com¬ plaining witness.
Rhodes and his friends took nev; hope after the dismissal of the Box Indictnient. Throughout the aflo.- noon of Thursday , the second day of the trial, practically every scat in the courtroom was filled. It wasa sym pathetic audience that listened to the sensational proceedings. Especially during the summing up of Lawyer Clock, many of those who had bee unmoved during the day broke down and wept. Clock said he was appeal¬ ing for the accused because he was his friend and that he expected no r-- muneratlon.
During the trial the defense repea'- edly challenged the witnesses for th ; people. He declared that tho.se who were In the jail were criminals bv their own admission and questlone'i the truth of their stateinentj?. In his summing up he I'elentlessly assailed their veraslty and pointed to their careers as evidence of their character.
