JUSTICE KELLT TO GIVE VERDICT IN DIVORCE ACTION NEXT WEEK—HRS, MILLER ALI^GED STATUTORT GROUNDS.

RESTRAIN NEENAN ELEVATOR GOIMNY
THBOUGH ATTORNIT E. E. ED- WABDS FBEEPOBT BESIDEHT SECUBES IHJUNCttOH AGAINST S2.000.000 CORPOBATIOH—SUIT TO BE TklED IN TBE FALL.
tSp»iclal to Tho Nassau Post.)
Henry C. Baden haasen of Whaley street, Freeport, has brought an ac¬ tion' as a stockliolder, against the Neenan Elevator Company, Brooklyn, N. Y., and several other defendants, to set aside an agreenwnt entered into by the directors of the company with former Now York State Senators John F. Heally. The Neenan Ele¬ vator Company is a $2,000,000 corp¬ oration. Mr. Badenbausen charges in the complaint flled by his attorney, ex-Judge Elvln N. Edwards, that the agreement made hy the officers of thej company with Senator Healy was of such a nature as to practically dis¬ solve the corporation and freeze out the minority stockholders.
An order to show cause was issued by Supreme Court Justice Van Siclen on Saturday laat and made returnable before Justice Kelly at Brooklyn ou Wednesday.
The claim of ,the plaintift is that the Neenan Elevator Company, which is a rival of the Otis Elevator Com¬ pany of New York, is at a stage in ils career when it is about to make a lot of money for its stocholders aud because of that fact, the majority stockholders are attempting to freeze out the minority stockholders, and it ia to off-set this that thia action Is laken.
Mr. Badenhau.sen asks that the of¬ ficers of the company be enjoined from further carrying out the con¬ tract and that a receiver be appoint¬ ed to protect the business and assets of the company during the determin¬ ation of ttie suit. The case will be tried at the September term of the Supreme Court in Nassau county.
