charges that NEPCO has
breached its oil supply contract
with LILCO.
According to the Company
spokesman, LILCO, along with
Virtually all other oil dependent
utilities, has seen its fuel cost
escalate dramatically in recent
months and, like other utilities,
LILCO's first concern has been
the maintenance of an adequate
and reliable source of electricity
to its customers. Despite the fact
that LILCO is not alone in ex-periencing
these heavy fuel
expenses, t|ie spokesman said,
"We cannot overlook the enor-mous
impact the high price of oil
has had on the Company and its
customers. Therefore, LILCO
has commenced these actions
with the full understanding that
the litigation may well be long
and time consuming."
Should favorable judgements
by the Courts result in the money
damages requested, the
spokesman continued, the
Company plans to refund to its
customers any amounts
recovered that represent actua)
overpayments for fuel that have
been paid by customers. The
allocation of any other money
awarded will depend upon the
type of damages allowed by the
Courts as well as any applicable
directions of the Courts and
appropriate regulatory agencies.
The monetary claims made by
LILCO in the court action against
the major oil companies include
$186,000,000 for the anti-trust
violations or $124,000,000 for the
interference with contract claim.
