Board Denies Redi-Whip
Exception
FIRE PAGERS ISSUED TO LFD. Lynbrook new fire
notification system for the volunteers of the Lynbrook Fire
Dept. is now in full operation with the recent distribution of
a Hre pager to each of the 225 volunteer Hrefighters. The
pager is about the size of a targe pack of cigarettes, and is
worn on the belt of a firefighter. It will notify the firefighter
immediately when a fire or emergency occurs in the Village
and improve the response time to the r^idents in need of
help. The pagers were distributed after Nassau County
installed the necessary computer software at FIRECOM
Center in Mineola. Last year, the Mayor and Board of
Trustees approved a $140,000 Bond Issue to purchase the
new system. In the above photo, Mayor William P. Geier is
shown one of the new pagers by Fire Chief Robert Gleason.
Mayor William Geier and
the Board of Trustees have
announced the denial of the
special exception request by
the owners of the Redi-
Whip property on Merrick
Road to change the zoning
from light manufacturing
and residential to commer-cial
and build a four-story
commercial building, 60 feet
in height, on the site.
Mayor Geier made the
announcement at the Board
Meeting held on March 2,
1987. According to Mayor
Geier, the reasons for the
Board's denial of the
planned structure were
many. The first was because
the Village has lowered the
permitted height qf new
c6mmercial sti"uctures from
four stories to three (at a
total height of 40 feet). That
new ordinance went into
effect in November 1986 for
projects not already under
construction.
A second reason for the
rejection was the building's
proximity to the residential
area near Vine Street, which
the project would abut.
The Board also believed
that this large building with
a possible large employee
population would cause
additional traffic problems
on Merrick Road.
In addition, the project
was also denied as it does
not have the required
number of off-street parking
due to the new local law,
approved on February 17,
1987, that now requires one
parking space for each 250
square footage of office
.space. The previous code in
existence fo/ahnost 25 years
had required one space for
400 square feet of office
space. The new law now also
requires parking spaces be
allocated for square footage
of storage space. According
to Mayor Geier, it is now up
to the owner of the property
to come back with another
proposal that will not have a
negative impact on the area
arfd one that conforms to the
new code requirements.

Tuesday, February 17th
was a combined Board
Meeting and Grievance Day
at Village Hall in Lynbrook
from 3 pm on until 7 pm.
Mayor Bill Geier explained
t h a t there significant
decreases in assessment for
village property, "much
lower than last year."
The New York State
Board of Equalization sets
the assessed value for several
local franchises, such as
Long Island Water Corp.,
New York Telephone,
AT&T, Cablevision Nassau
and Cablevision System-Ll
Corp. He stated that the
assessment for each of these
franchises was less than last
year, and further stated,
"that the total increase in
assessment for the village
was a little under $3 million
dollars, but the special fran-chise
assessments was
decreased by $2,042,379 by
the State Board of Equaliza-tion
for the year, leaving a
net increase of slightly less
than $1 million dollars." He
pointed out that the state
should not be controlling
things at the local level and
directed the Village Assessor
to contact the New York
State Board of Equalization
to question them in regard
to Lynbrook's decreased
assessment.
The Mayor explained that
usually there are about 200
certiorari claims submitted
each year filed by commer-cial
enterprises who chal-lenge
their tax assessment in
court frequently. Mayor
Geier further stated "The
problem results when the vil-lage
assesses a property on a
"brick and mortar" basis
and the Courts assess the
properties which file certio-rari
claims under "the
income capital basis." He
maintained that the New
York State Legislature
should require the same
assessment procedure for
both a village and the courts.
