Town lifts building moratorium
It's back to business for thousands of builders. The Town of Hempstead's council members voted recently to lift the building moraiorium. effective immediately.
A building moratorium had been in place the last eight weeks in response to complaints by residents and civic associations about over-building.
The moratoriimi was an oppormnity for the towTi to review some of its building codes. On June 19 board members proposed and adopted several new amendments that addressed side yards
and set backs, the maximum size of a house within Residence B zone and ma.x-imum heights for homes in Residence B zone.
Supervisor Kate Murray said the town would continue to review its building codes.
Tow^n codes have required 6,000 square foot lot sizes for residences. Many civic groups have bemoaned the proliferation of subdivisions that are less than 6,000 feet. As explained by Supervisor Murray, after declaring the moratorium, board members held discussions
with leaders of civic associations, builders and developers and members of the Council of Chambers.
Though there is still much work to be done, three proposed amendments were approved at the meeting this week.
The first regulation addresses the concerns about side yards. Under existing codes, each residence should have two side yards with the total width of 15 feet, though neither yard could be under five feet.
The new amendment stipulates that in cases of a lot size of less than 50 feet,
the "minimum required aggregate side yard width shall be not less than the average side yard aggregate widths established by the existing main buildings" of the lots within 200 feet on either side. The exception to the rule is that the maximom side yards total 15 feet and neither can be a width less than 50% of the opposite side yard.
On building lots of 50 feet, but less
than 60 feet, the minimum aggregate
side yard should be 15 feet with neither
yard less than 50% of the opposite yard.
