GUILTY!!!
by Laura Schofer
Kenneth Middleton of Hempstead was found guilty of Murder in the Second Degree on June 23 in Nassau County Court for the shooting death of 15-year-old Dianna Correa.
She was killed on June 21,2004, while sitting on the front porch of 53 North Columbus Avenue in Freeport. Michael Gillard, 16, of 53 North Columbus Avenue, was also struck by a bullet in his leg and taken to an area hospital.
According to Nassau County District Attorney Denis Dillon, Mr. Middleton fired several shots from a handgun at two men and a woman at 53 North Columbus Avenue after riding by the house on a bicycle.
According to prosecutors, Mr. Middleton mistook a young man sitting on the porch for an old enemy. Instead, Mr. Middleton killed Dianna Correa, a former Freeport resident who was up from Florida and visiting friends.
It was reported in Newsday that Louis Milone, Mr. Middleton's attorney, said his client had nothing to do with Ms. Correa's death.
Mr. Middleton was also found guilty of Assault in the Second Degree, a Class D Felony and Assault Third Degree, a Class A
Misdemeanor.
Murder in the Second Degree (Intentional) is a Class A Felony. Mr. Middleton faces 25 years to life in prison. He will be sentenced by Nassau County Court Judge Meryl Berkowitz on August 12.
"I am thankful that the family's prayers were answered and the person responsible [for this crime] has been convicted and will face the consequences of his actions," said Freeport Police Chief Michael Woodward. "I am also thankful that the community came together to assist in the prosecution of this individual," he added.
Last July at a community meeting sponsored by the Northeast Civic Association, people expressed their anger and outrage over the taking of an innocent life.
"I cried the night of the shooting. I knew that young lady," said Freeport Police Detective Benny Andujar. "I knew her family and I had to be the one to tell them their daughter was dead. Believe me, there was not a man standing there with dry eyes."
Freeport school board President Carmen Pineryo said at that same meeting that she had "just seen her [Dianna] the day before. She gave me a hug and said, 'Please convince my parents to let me stay here in Freeport.' It's so terrible. I'm so sad. The whole community is sad."
