The Board's vote to approve
the Special Assessment uUtrict
came after a public hearing, at
the end of which they had voted
— also unanimously — to reserve
decision. They then retired Into
executivt session. They returned
some time later to finish out an
eariier open legislative session of
the board — which had preceded
the public hearing on the Special

that the tax increase would

Mayor WiUiani White pointed
out to Posner that half-dozen
people were not being taxed, but
that probably 70>>80 property
" owners were within the Special
Assessment District. White also
noted that the Freeport Chamber
of Cbmmerce had strongly
urged the village to create the
additional narking and to assess
the proper^ owners Invtdved. He
told Posner that he felt the plan
was fair.
Another oppotitioo speaker
was Alan Lebowitz, an owner of
Majestic Chevrolet on Newton
Boulevard. He questioned the
basis tender law that allows a
munidpaltty to "determine that

Murray Maurer read aloud a

attorney had sent the board
that legal aiction would be taken if
the board approved the Special
District. "It fs apparent.*^ the
letter stated, "that industrial
property owners, who have
nothing to gain from additional
Mall parking or increased shopping,
should, not be Included In
such taxation." Maurer said the
legal tests agaiiut the proposal
would cause the village additional
problems and costs.
Robert Leeds, of 40 Newton
Boulevard, site of a Beautv
Supply store criticized the Mkll
merchants for parking in the
fields behind their stores. If thev
would not, he claimed, an additional
