FREEPORT • Tl)e"13.2 acres of Bennington Park land, sold recently
by the village of Freeport to Brent«ood Development Corporation as a
site for a "Two Guys" Discount Store, ii experiencing "title" problems.
Considered municipal land, a recent title search finds no
evidence that the streets that once criss-crossed the more than 60 plots
were ever officially, dedicated to
the village.
The question appears to be just
a legal one and village soarces
express no fears that the sale of
the land Is in jeopardy.
According to Mayor William
H. White,, the property*! early
owner, Newton Bennington, filed
a development map in 1902.
Appatcntly, WMte sud, Bennington

the developer. Bennington, to
have the developer, Bennington,
dedicate the streets to the village
so It coald maintain them. TMa
procedure. In fact, was recently
followed in the case, of Liberty
Park" Drive. Bat,^'sonielhlag"/ell-between
the cracks" back in the
early .1900's, White notes, and
the streets were never dedicated
to the village. However, the
municipality maintained them
throughout the years, plowing
them, cleaning them. etc.
When the village began to
accumulate the property for redevelopment,
it assembled the
-more than 60 lots, many of which
were guaranteed by different-title
companies. Public hearings
were legally advertised and
n>nductcd and' the streets were
ufnctally abandoned, paving the
way — "it was believed — for the
sale of the entire acreage to
Brentwood for $1.083.780.
White said he believed that,
while the title company has to
guarantee title to the street,
"under all legal deflnltloas," the
village does .own them, becatxse
Uda niiinldpaUt^f developed and
. matotaliMd- tHon over a long
'periddbftiine.
It would appear that while the
legal researcn continues, the land
just lies there. Necessary legal
procedures would take, Wtute
surmised five to six weeks.
Certainly, until tide to the entire
plot-is-clear, If would-not. be _
expected that construction could
sUri.
Meanwhile, although there has
been speculation that a recent
corpt)ratc confiicl in the parent
company of "Two Guys" could
change that company's philosophy
of building stores out of
New Jersey, no oHicial word from
"Two Guys" ha* yet indicated
that the Freeport stJire would not
be built.
