Commissioner Ousts Tucci
From IT School Board According to press
reports today, December
.17, Commissioner of
Education Ewald B
Nyquist has removed
James Tucci of Seaford
from his position as
trustee on the Island Trees
School Board.
Nyquist's decision was
the latest in a series of
exchanges caused by
Tucci's membership on
both School and Library
Boards in District 26.
(Island trees). Earlier
this year, Nyquist ruled
that the two offices were
"incompatible", based on
possible conflicts between
Tucci's role as a school
and library trustee.
Tucci, who learned of
the decision from a
reporter, stated he would
seek an injunction against
the action and that he
would appeal the decision
to the state Supreme
Court. r
Tucci was elected to the ,
Tucci noted that there is
no statutory prohibition to
serving on both boards at
once, and he questioned
the Commissioner's right
to define the offices as
incompatible. He also
argued that the ruling was
not based on any specific
charge of conflict-of-interest,
but, on
hypothetical situations
which, he felt, have little
Chance of arising in Island
Trees.

From The Staff Of
to the Commissioner's
original order. Here,
Nyquist argued that Tucci
would be iBr an "incompatible"
situation
were the two boards to
have contract dealings, or
if the library board was
seeking a new, building
(the school' board would
hay^ to approve site
selection). These were the
only two examples Nyquist
gave of possible conflicts.
Tucci called both
examples far-fetched. He
claimed that no contracts
had been made between
either boards, and he
pointed out the rare
likelihood of library expansion.
(Ed. note: The present
library building in Island
Trees was secured after
years of hard-fought
campaigning for a public
library).
Noting that some school
board members sit on the
BOCES (Board Of
Cooperative Educational
Services) Board, which
established contracts with
local boards throughout
Nassau County, Tucci
maintained that there
were legal precedents foi
his dual board mem
bership.
Finally, the ouste<
school board member
repeated a statement he
made when first ordered
by Nyquist to vacate either
his school or library
position.

DOG'S BEST FRIEND: Melissa Aviles, of Levittown,
cuddles her choice in the annual "Adopt a Pup for
Christmas" drive at Hempstead Town's Animal
Shelter, Wantagh.
. "With the cheer of Christmas
here, why not have a pet near?"
Thus spoke Anthony J.
Ferrara. warden of Hempstead
Town's Animal Shelter.
"What better way to bring the
spirit of Christmas to a youngster
through the heartwarming
companionship of a pet? And the
price is right, only a $3 service
charge plus license fees."
Ferrara pointed out.
The town animal shelter, in its
annual drive to encourage
adoption of a pet for Christmas,
has 132 dogs, 52 females and 80
males, available now. Most of
these animals were either strays
brought in by town shelter personnel
or pets whose owners
could no longer keep them. They
are of all ages and most are
mixed breeds.
Adoptions this year have
reached all time record; 650 dogs
have been placed in new homes
and 6,200 dogs have been housed
throughout the year at the
shelter, Ferrara explained.
The town shelter is located at
Beltagh Ave., Wantagh. The
adoption hours are 1 to 4 p.m.
Monday through Friday and 10
a.m. to 3 p.m. on Saturday. The
shelter is open Monday through
Saturday from 8 a.m. to 4:45 p.m.
for persons wishing to view the
animals.
In addition to the $3 service
charge, persons adopting dogs
are required to purchase a
license at a cost of $2.35 for a
male or spayed female, and $5.35
for an unspayed female. The
shelter does not handle cats.
