Town Eases Memorial
Day Restrictions
Acting on the advice of Oyster
Bay Town Attorney, Bernard F.
McCaffrey, the Town Board this
week passed a local law governing
trade regulations on
Memorial Day.
Rescinder and repealed in its
entirely was a May 13, 1958 ordinance
prohibiting most
businesses - other than food
suppliers and those considered to
be essential for the public good,
to operate at any time on
Memorial Day.
The new law prohibits all
trades, manfactures and all those
involved in public selling, from
operating between 9 a. m. and 1
p. m. Food suppliers, grocery
stores, delicatessan dealers, and
similar small food suppliers and
restaurants are still permitted to
open before i p. m. under the new
law. Violators shall be punished
by a fine of not more than $ 100 or
imprisonment for not more than
15 days or both.
McCaffery said the Town took
this step after his stall reviewed
recent Court decisions. He cited
a case againist the Town of
Huntington, as an example in
ruling againist a municipality
restricting trade in its entire ty
on Memorial Day. McCaffrey
said it was not the Town's wish to
diminish their importance of the
holiday by allowing firms to open
later in the day. " We feel,
however, that we will have a
better chance of upholding this
law it it ever comes to a case
where we must go to court".
McCaffrey commented.
