VILLAGE BOARD DENIES
APARTMENT APPLICATION The Board of Trustees of the Inc. Village of
Farmingdale conducted a public hearing on Monday
on the application of Norman F. Sullivan and
Catherines. Nielsenfor " Special Use" permits to
erect two apartment buildings containing 62 units
of apartments on the south side of Conklin Street,
between Secatogue Avenue and Oakview Avenue.
About 25 interested taxpayers and residents attended
the hearing. A petition signed by property
owners adjacent to the Sullivan and Nielsen property,
was presented to the Board of Trustees as
opposed to the apartment house.
Under Section 179, Village
Law, protests registered by 20
percent or more of owners of
property immediately adjacent
extending one hundred feet or
more, or by the owners of property
directly opposte thereto, extending
one hundred feet from the
street frontage of such opposite
land, any zoning amendments
shall not become effective except
by the favorable vote of
three fourths of the members of
the Board of Trustees. ( The petitions
represented about 32%
of the adjacent property owners,
according to Village Clerk James
McKenna).
Some of the arguments presented
in opposition to the application
objected to the parking
area abutting residential homes;
garbage receptacle location; the
area does not lend itself to apartment
house construction; playground
area is not sufficient in
size, cesspool problems and also
that the value of surrounding
property would be destroyed.
I. Leonard Feigenbaum, at attorney
. questioned the judgement
of the Board in entertaining further
applications for rezoning
to apartment house use in that
the Fulton Street complexes appear
to be adequate for the Farmingdale
area, and furthermore,
other areas so zoned for apartments
have not been fully utilized.
Attorney Kendrick C. Smith,
representing Sullivan and Nielsen,
in rebuttal, replied that the
area directly opposite the peti-tionsers'
property was zoned for
business as well as multiple
dwellings, therefore, " spot zoning"
would not occur, Conklin
Street is a heavily traversed
roadway and does not lend itself
to the development of single or
two family residences, and the
owners, having held the land in
