The ground of the action is that tho service charge is a violation of section i!«6 of the tranaportatlon corporallona law which provides that no rental di¬ rectly oi Indirectly shall be charged by any gas comjiany for its meters. Wheth¬ er a aervice diarge violates thia provis¬ ion of the law la n mooted question, as tliere haa been no direct caso. Counsel for the gas qornpany havo requoattKl an adjournment of the motion for llirr in Junction and the matter has not yet come up In court for the decision, lii tho meantime It la stated that Juatloe Squlers' preliminary injunction remains In effect, and until it Is decided and the order of the .court entered there, no cfinsunier of gas In the town of Hemji- stead ts obliged to pay any service charge, aocordlng to Mr. Maxson.
